Wrongful Death Cases:

The purpose of the Florida Wrongful Death Act is to shift the indescribable loss suffered by the family of the decedent to the wrongdoer, thus making the wrongdoer legally responsible for the Wrongful Death.

ANYONE SUFFERING THE LOSS OF A LOVED ONE FROM A WRONGFUL DEATH SHOULD SPEAK TO AN ATTORNEY AS SOON AS POSSIBLE. Why, because as soon as an attorney decides to take your case, there are a variety of steps the attorney should take in order to insure your rights are protected as well as to make sure all evidence and testimony are preserved and documented for both trial and the jury.

A good attorney starts both thinking about and preparing your case for trial the same day he or she is hired. The ideal situation is to present the jury with the "whole story," so their decision will be based on all of the relevant facts, testimony and evidence. For example, relevant photographs and/or video should be immediately taken to document conditions as they existed at the time of the incident or accident, this includes documenting the accident scene, the premises, the vehicles, products, equipment, property damage, etc. The attorney should additionally take steps to promptly obtain written or recorded statements from witnesses while the facts are fresh in the witnesses' mind.

Once an investigation of the case is complete, Florida Statutes provide that the Personal Representative of the decedent's Estate brings or files the lawsuit seeking damages on behalf of the decedent's Estate as well as the decedent's survivors, who the attorney will specifically identify in the lawsuit.

Since in a Wrongful Death case the deceased is unavailable to personally meet and tell their story to the jury, it is extremely important that the attorney learns all about the deceased, the deceased's life, the deceased's relationships with family and friends, the deceased's involvement in the community, the charity work provided by the deceased, and all that made the decedent special. It is only then that the attorney can properly and completely present the "whole story" of who the decedent was to the jury.
